Hi everyone ,

I found this site while attempting to research reporting "Regulations" , possibly someone here can help to point me in the right direction.

I filed for Bankruptcy in 2/02 . Chapter 13.

I was 4 months behind on my mortgage at the end of a 20 year marriage .....

Since filing , my mortgage has been paid every month within the Credit Union grace period. On a handful of occasions I've paid it a couple days beyond the grace period but certainly never 30 days late , not even 20 days late each month.

Despite this , the Credit Union was reporting me as behind by several months until the trustee caught the payments up through my chapter 13 plan. This has killed my credit score , on top of the bankruptcy, and is going to mean a much higher interest rate should I refinance.

I've been told by my Attorney , the Trustees office and a loan officer that specializes in re-financing people in bankruptcy that once I filed chapter 13 that all payments to the Credit Union , if made on time , should be reported on time by them to the credit agencies. Despite everyone being mystified that they are reporting it this way , noone seems to have a copy of a specific "regulation" that states how the Credit Union should report once I filed.

The Credit Union is telling me that they are not aware of any such regulation and feel that they have reported my payment status fairly.

Is anyone here aware of any documented regulations that dictate the Banks/Credit Unions reporting responsibility ? Is this something that I can find on the web. I live in Maine , and would imagine that I would need to look up regulations for my State ?? Where does one do this ??

The Credit Union told me today that if I can send them a copy of such a regulation that they would "work with me" on it.

I've worked very hard over the last three years to put the pieces back together and am so disheartened with how the Credit Union has chosen to report .....

Any help , from anyone , would be greatly appreciated :)

Here is something else to read:

This is one of the best ways short of suing, and often BETTER than suing to get immediate results. Of course there are companies who don't care, but even if it doesn't get you the desired results, you're doing the rest of the world a favor by publicizing how they do business and you can still resort to legal action.
