Re: Notice of illegal marketing in violation of the TCPA and offer to settle

Today I received an unsolicited fax from your Whistler resort in violation of the Telephone Consumer Protection Act. (TCPA). Your fax is posted at

1) I am offering to settle the 4/19/05 TCPA violations for US $250 with the following terms:

a) Four Seasons Hotels agrees to immediately cease all illegal junk fax advertising and that any future junk faxes will be considered willful violations of the TCPA.

b) Four Seasons provides the contract with the entity who provided my phone number (identified on the junk fax as “It’s the fax”), all available documentation pertaining to this entity and an affidavit certifying the authenticity and completeness of the documents.

This offer expires on 4/20/05 at 5 PM.

2) Should you decide to ignore me, I will publicize the Four Seasons illegal conduct with the intent to locate other junk fax recipients to share legal expenses and possibly file a class action.

I will strive to damage the Four Seasons reputation and to inflict damages by far exceeding the short term profits from the illegal fax advertising.
