Yesterday I posted at the blog:

MyFairCredit.com is cream skimming for corrupt consumer lawyers

Today I got an e-mailed response from David Szwak, one of the MyFairCredit lawyers and he had asked me to post a link to the new site a few weeks ago. I FINALLY started this long overdue topic.

Why haven't I started this topic a long time ago?

For years people have been complaining about Krohn & Moss.

Obviously, few people dare to publicly complain about their attorney - they might just get sued. But I've gotten a lot of complaints in confidential e-mails.

I hoped that the "consumer advocate lawyers" would somehow come through. I didn't want to burn bridges. At this point, I've got nothing left to lose and it's definitely time to expose how evil this system really is.

Long-time readers may remember this quote from my credit forum a number of years ago and I brought it back at http://mylitigation.net/:

QUOTE
In keeping silent about evil, in burying it so deep within us that no sign of it appears on the surface, we are implanting it, and it will rise up a thousandfold in the future. When we neither punish nor reproach evildoers... we are ripping the foundations of justice from beneath new generations.

- Alexander Solzehnitsyn

America is a country in rapid decline and on the fast track to self destruction, very much like the Soviet Union 25 years ago.

Justice mostly exists for the affluent, freedom of speech is disappearing rapidly, I can't even host my websites in the US anymore.

Substitute KGB with corporation - they've got the power.

For the most part, justice in American courts means that whoever can pay the best liar wins. The corporations have UNLIMITED funds.

Consumers who've been forced into bankruptcy and/or foreclosure have nothing. Even your average Joe with a middle class job and a few thousand to pay an attorney doesn't stand a snowball's chance in hell against the bankers and CRAs.

See my My 7/4/05 Complaint to the Arizona State Bar, "I request that you disbar Joseph Udall, Kathleen A Biesterveld and Kevin D Quigley

Of course I knew that the Bar's purpose is to PROTECT the scumbag lawyers and I know that the lawyers are laughing their heads off, they know how absurd my request is.

But, "normal" people don't believe me, so now it's fully documented:

The scans of the Bar letters declining to investigate

The best part is the letter the Bar sent to the Capital One attorneys:

The 7/19/05 AZ Bar letter to the Capital One attorneys

To fully appreciate the Bar's corruption you have to read my response to their complaint about my unlawful practice of law.

The AZ State Bar falsely accuses me of practicing law.

This wasn't the first time I filed a Bar complaint, I previously had the Utah Bar protect Victor Lawrence, at the time running the credit repair scammers Lexington Law.

I have been disgusted with the lawyers who misrepresent themselves as "consumer advocates" for many years.

As I'm preparing to finally leave the country, I have to dismiss my lawsuits if I can't find an attorney. I've been really trying hard to find a lawyer, but no such luck.

For over 10 years I've been dealing with FAKE consumer lawyers.

My very first experience with scummy consumer lawyers was in 1994 during my very first fully documented investigation of mortgage fraud:

Transamerica admits $15,096.90 "Error"

I had started a nonprofit to help people in foreclosure and the other directors had me replace "fraud" with "error." It was no error, it was deliberate FRAUD.

I'll never forget the attorney who demanded a $2,000 retainer to send a letter to Transamerica.

Those BASTARDS!!! Lawyers are worse than creditors or collectors. We couldn't find an attorney and my life turned to shit because I was so naive and fell for the consumer advocate and regulator crap. In 1996, I filed for bankruptcy.

1997: FNMA - Nationsbanc - KeyCorp Conspiracy to Defraud Cindi out of her home

I was in no financial position to make these trips to So Cal to personally review the original money order receipts, but I just couldn't say "no" to Cindi and her little girl.

These pages were down for a few years, but a few months ago I spent several days updating and re-posting this depressing fraud documentary.

How can attorneys pass the Bar exam and be too damned stupid to ADD????

Not to mention that bastard of a judge who ruled for FNMA.

I knew it would be hell having to relive that nightmare, but with all the desperate pleas for help from people in foreclosure, people need to see how horribly wrong everything can go - even if you made every single payment.

Fast forward to 2002. I had called just about every lawyer in my county (nobody took any FCRA cases, they didn't even know what it is) and then I called the "consumer" lawyers in Phoenix.

I had no money for a retainer and nobody was interested in taking my case on contingency. That's probably because I have a bankruptcy on my credit and I have yet to find an attorney who will represent consumers with bankruptcies.

Before I filed my first federal suit on 3/19/03, I paid someone $250 to again call the lawyers and again there was no interest. I just needed to make sure that it wasn't my attitude that caused the declines.

On 6/10/04, I filed my second suit, mainly to refile against Equifax and Capital One since they had been dismissed due to late service. And I added Ameriquest and Target with new claims.

Since I want to leave the country, I either find a lawyer or I have to dismiss my suits and just let it go. I've done an awful lot of work and would hate to have to dismiss, but the sad reality is that I can't prevail on my own even if I wasn't leaving the country.

I live in the middle of the desert and the nearest town is Kingman, 75 miles away. There's a small law library, but they have NO books on federal law.

It's over 250 miles to Phoenix, at least a 5 hour drive if there are no traffic problems. It's not a freeway drive. I can't just swing by the courthouse to watch some hearings to see how things work.

I've filed a junk fax suit in superior court in October 2004, not only because I hate the faxes, but mostly because so many of the junk faxes are nothing but a bunch of lies and frauds and especially the MORTGAGE and HEALTH CARE faxes cause tremendous damages to my readers.

People pay for health insurance and when they go to use it, they find out they've got nothing or they only get a small discount off a huge bill. A lot of info about junk faxes is also at my blog at http://junkfaxsuit.info/ You'll see how the TX AG sold out, allowing the scammers to continue to operate. He explicitly condoned the illegal junk faxing in the settlement. What a freaking moron! All in the name of cash being sent to Texas.

And of course I have a personal interest in mortgages, not only because I've investigated mortgage fraud, but I also used to be a California real estate and mortgage broker and the only real money I've ever made was in real estate. I've spent quite some time researching properties in my neighborhood, but it looks like I couldn't get a mortgage if my life depended on it.

See the Ameriquest topic with a lot of info on Ameriquest and the documentation of my own claims.

There's ASC / Wells Fargo with some sad stories of consumers in foreclosure - of course they can't find attorneys either. Mortgage servicing fraud is so HUGE and the CONSUMER ADVOCATE attorneys so totally sold out.

2002: Wells Fargo and the Buckley Firm conspiring to fraudulently foreclose on Lynette's home.

I consider this documentary some of my best work. The fact that you see this title with WF and Buckley KNOWING about it since its creation in 2002 tells you that everything I say is true.

They steal peoples' homes.

The publication did result in the loan modification, but Lynette couldn't find a lawyer DESPITE 500% PROOF of the fraud.

The life of Lynette and her family changed forever. Subsequent divorce, 5 kids, and continued severe financial problems ... I sent Lynette an e-mail a few months ago, I'm concerned that WF added a bunch of fraudulent fees through the modification. I didn't get a response, I hope she's ok.

I can't remember any of my clients being entirely happy with their attorneys IF they were fortunate to find one. I stopped referring to specific attorneys years ago - it only reflects negatively on me when I recommend someone and the consumer is either immediately declined or jerked around for a few months to be eventually declined.

Unlike for credit declines, lawyers don't have to tell you WHY they don't want to represent you.

Often, they falsely state that you have no legal claim.

We have discrimination laws for creditors and SHOULD have those same laws for lawyers. They'll always be cream skimming, just like there's always going to be housing and lending discrimination. But it would be a lot easier to document if we had some statistics. I can only go by rather extensive personal experiences and my readers' and clients' reports.

Could some lawyers please post what percentage of consumer inquiries they decline?

And why?

I would like NOTHING more than having lawyers to refer to, knowing that every case with valid legal claims will be accepted.

I recently posted at the blog:

Edelman, Combs & Latturner sanctioned $18,000 for extortionate FDCPA demand letter

This is NOT what I want consumer attorneys to be doing. According to the ruling, there wasn't even a chance of any violation.

I also thought that $2,000 for writing a letter with NO time to spend on reviewing CRA disputes or anything but the collection letter is really steep.

Why is it not profitable for lawyers to write such settlement letters for DOCUMENTED claims, such as CRA verifications after disputes, reporting of fraudulent collections, etc.?

FDCPA claims come with STATUTORY damages and legal fees.

What exactly is the problem?

Why doesn't NACA have an intake system with a couple staff lawyers sending out these settlement letters and if they can't be settled, the credit is STILL screwed up and the consumer wants to pursue the matter, assign it to a lawyer for litigation?

I am convinced that if *I* had just $50-100K, I could hire a staff attorney, it could be someone straight out of law school and I'd be running a PROFITABLE business.

This is all so slam dunk - almost as easy as the collection attorneys sending out their settlement offers.

I realize that it takes a little more time to get the info from consumers, but it's not like they're not willing to PAY for professional help. The credit repair scammers like Lexington, Bradley Ross and Ovation make a fortune -- permanently damaging the consumers' credit rating through the deletions of good and beneficial derogatory accounts.

Not to mention that they don't provide copies of the disputes, consumers don't know WHAT was disputed and HOW, and they are branded as "credit repair" disputers. The CRAs refuse disputes and it makes those consumers even less desirable for the cream skimming attorneys.

It is SO incredibly easy for an organization like NACA or MyFairCredit to make good money and provide an extremely useful service for consumers AND attorneys and to MAKE A DIFFERENCE for all.

I'm looking forward to see some responses from lawyers, maybe I'm missing something.
