Equifax attorney Love:

"Love explains by affidavit that he had no memory prior to that epiphany of sending the email, that he never intended to improperly withhold the letter, and that he forgot about ever receiving it prior to the time he prepared for the settlement conference."

Oh, he FORGOT!

After the magistrate judge granted the Equifax motion for summary judgment, judge Arterton decided that a jury might find Equifax liable for PUNITIVE damages and apparently they then settled.

Apparently there were NO actual damages allowed. Postage was ruled not damages as NOT incurred due to the violations but PRIOR (although Equifax had PREVIOUSLY failed to provide the consumer disclosure) and emotional distress ruled not applicable. If I read that right, you're not supposed to be worried until AFTER you received the report? HUH?

If somebody spits in your face you're not supposed to be angry and you're not to worry about getting AIDS until it can be confirmed that the spitter had AIDS?
